AX INSTITUTE ACCEPTABLE USE POLICY AND PLATFORM SECURITY POLICY

This Acceptable Use Policy and Platform Security Policy (“Policy”) governs access to, use of, interaction with, administration of, and participation in the websites, applications, educational systems, enterprise systems, AI-enabled systems, learning platforms, credential systems, APIs, integrations, operational technologies, and digital services provided by AX Institute through the platform located at www.axinstitute.online (the “Platform”).

The Platform is operated by Active Patterns Inc., operating under the brands AX Institute and AX (“AX Institute”, “AX”, “Institute”, “we”, “our”, or “us”).

This Policy applies to all:

  • users;

  • learners;

  • subscribers;

  • instructors;

  • mentors;

  • enterprise clients;

  • enterprise learners;

  • organizational participants;

  • contractors;

  • administrators;

  • facilitators;

  • contributors;

  • organizational representatives;

  • visitors;

  • participants;

  • third-party integrators;

  • authorized users;

accessing, administering, integrating with, or using the Platform or AX Institute Services.

This Policy forms part of the AX Institute governance framework and shall be read together with the:

  • Website Terms of Use;

  • Enterprise Services Agreement and Organizational Terms;

  • Enterprise Data Processing and Data Governance Addendum;

  • AI Acceptable Use Policy and AI Governance Policy;

  • Academic Integrity Policy and Learner Conduct Policy;

  • Community and Professional Conduct Policy;

  • Certificate and Credential Usage Policy;

  • Subscription and Membership Policy;

  • Privacy Policy;

  • Accessibility Policy;

  • applicable Terms and Conditions.

By accessing or using the Platform, users acknowledge and agree to comply with this Policy.

Nothing in this Policy creates fiduciary, advisory, agency, employment, outsourcing, partnership, consulting, professional-client, cybersecurity-certification, operational-guarantee, or guaranteed availability relationships between users and AX Institute.

AX Institute does not guarantee uninterrupted availability of the Platform, enterprise systems, APIs, credential systems, AI-enabled systems, operational technologies, integrations, cloud infrastructure, educational systems, analytics systems, monitoring systems, cybersecurity systems, or related operational infrastructure.

 

1. PURPOSE OF THIS POLICY

The purpose of this Policy is to:

  • protect Platform integrity;

  • maintain secure educational and enterprise environments;

  • protect enterprise systems and educational infrastructure;

  • protect AI-enabled systems and operational technologies;

  • prevent abuse, fraud, scraping, automation misuse, cybersecurity threats, or operational disruption;

  • preserve educational integrity and credential integrity;

  • protect intellectual property and educational methodologies;

  • maintain operational continuity;

  • support lawful and authorized educational participation;

  • preserve enterprise governance and institutional credibility.

Users may use the Platform solely for lawful, authorized, legitimate educational, enterprise, professional development, or organizational learning purposes consistent with AX Institute policies and applicable laws.

AX Institute reserves sole discretion regarding acceptable operational use, enterprise governance standards, security methodologies, operational controls, AI governance methodologies, credential governance methodologies, and Platform integrity protections.

 

2. GENERAL PROHIBITED ACTIVITIES

Users shall not engage in conduct that:

  • violates applicable laws or regulations;

  • infringes intellectual property rights;

  • compromises cybersecurity or Platform integrity;

  • disrupts educational delivery or enterprise operations;

  • interferes with operational systems or AI-enabled systems;

  • circumvents security controls, subscription controls, enterprise restrictions, or credential systems;

  • interferes with other users’ educational experiences;

  • compromises credential integrity;

  • damages AX Institute’s operations, systems, enterprise relationships, or institutional reputation;

  • facilitates fraud, abuse, piracy, unauthorized automation, unauthorized extraction, or unauthorized commercial exploitation;

  • manipulates educational systems, enterprise systems, analytics systems, reporting systems, AI-enabled systems, or credential systems.

AX Institute reserves sole discretion regarding whether conduct constitutes prohibited activity, operational misuse, enterprise misuse, cybersecurity abuse, credential misuse, AI misuse, or Platform abuse.

 

3. PLATFORM SECURITY, CYBERSECURITY, AND SYSTEM INTEGRITY

Users shall not engage in activities intended to compromise, probe, disrupt, impair, manipulate, overload, bypass, interfere with, or exploit the confidentiality, integrity, availability, operational continuity, or security of the Platform or related systems.

Prohibited activities include, without limitation:

  • unauthorized access attempts;

  • credential theft or misuse;

  • password attacks;

  • account hijacking;

  • privilege escalation attempts;

  • vulnerability testing;

  • penetration testing;

  • reverse engineering;

  • bypassing authentication systems;

  • bypassing access controls;

  • bypassing AI safety controls;

  • bypassing monitoring systems;

  • bypassing enterprise restrictions;

  • denial-of-service attacks;

  • distributed denial-of-service attacks;

  • malware deployment;

  • ransomware deployment;

  • spyware deployment;

  • malicious scripting;

  • malicious automation;

  • phishing attacks;

  • injection attacks;

  • prompt injection attacks;

  • adversarial AI attacks;

  • API abuse;

  • unauthorized API access;

  • manipulation of credential systems;

  • manipulation of educational systems;

  • manipulation of operational systems;

  • manipulation of enterprise systems;

  • interference with hosting infrastructure;

  • interference with network operations;

  • unauthorized interception of communications;

  • unauthorized access to administrative systems;

  • unauthorized access to enterprise systems;

  • unauthorized access to monitoring systems;

  • unauthorized access to credential verification systems.

Users shall not attempt to:

  • impair educational delivery systems;

  • overload operational infrastructure;

  • interfere with enterprise learning environments;

  • disrupt workshops, mentorship systems, or credential systems;

  • manipulate analytics systems;

  • interfere with AI-enabled operational systems;

  • compromise monitoring systems or operational controls.

AX Institute reserves the right to implement automated security controls, operational restrictions, AI-enabled cybersecurity protections, monitoring technologies, blocking measures, fraud-prevention systems, operational integrity protections, rate-limiting systems, credential-protection systems, and enterprise governance protections reasonably necessary to protect Platform integrity and operational continuity.

 

4. AI SYSTEMS, AUTOMATION, SCRAPING, AND EXTRACTION RESTRICTIONS

Users shall not use the Platform, educational systems, enterprise systems, credential systems, educational content, AI-enabled systems, operational technologies, or related materials for:

  • artificial intelligence training;

  • machine learning model training;

  • large language model ingestion;

  • embeddings or vector database creation;

  • retrieval-augmented generation systems;

  • model replication;

  • model distillation;

  • synthetic dataset generation;

  • prompt harvesting;

  • automated educational replication systems;

  • automated enterprise replication systems;

  • automated credential harvesting;

  • unauthorized analytics extraction;

  • unauthorized operational replication;

  • unauthorized educational system replication.

Users shall not deploy, operate, utilize, or facilitate:

  • bots;

  • crawlers;

  • scraping technologies;

  • browser automation tools;

  • automated scripts;

  • automated extraction systems;

  • automated downloading technologies;

  • robotic process automation tools;

  • AI agents;

  • automated educational extraction tools;

  • automated credential extraction systems;

  • data mining systems;

  • automated monitoring systems;

without prior written authorization from AX Institute.

Prohibited conduct includes:

  • automated collection of educational content;

  • automated extraction of enterprise data;

  • scraping learner information;

  • scraping instructor information;

  • scraping enterprise analytics;

  • scraping credential systems;

  • systematic extraction of Platform information;

  • automated downloading of educational resources;

  • AI-assisted replication of educational methodologies;

  • AI-assisted replication of enterprise learning systems;

  • unauthorized model training using Platform content;

  • unauthorized harvesting of prompts, responses, frameworks, or educational methodologies.

Unauthorized automation, AI misuse, scraping, operational replication, or extraction activities may result in:

  • immediate suspension;

  • enterprise restrictions;

  • credential revocation;

  • technological blocking measures;

  • permanent Platform bans;

  • legal proceedings;

  • injunctive relief;

  • enterprise escalation;

  • operational enforcement measures.

 

5. DATA MISUSE, ANALYTICS MISUSE, AND ENTERPRISE INFORMATION RESTRICTIONS

Users shall not:

  • improperly access enterprise data;

  • misuse learner information;

  • misuse analytics systems;

  • misuse enterprise reporting systems;

  • export unauthorized enterprise information;

  • aggregate user data improperly;

  • attempt unauthorized data correlation;

  • misuse educational analytics;

  • misuse AI-enabled analytics systems;

  • disclose confidential enterprise information improperly;

  • interfere with credential verification systems;

  • harvest operational metadata improperly.

Enterprise information, educational analytics, credential metadata, operational analytics, AI-enabled systems, enterprise reporting systems, and monitoring systems remain proprietary operational systems protected by applicable laws and governance requirements.

 

6. INTELLECTUAL PROPERTY, EDUCATIONAL CONTENT, AND PLATFORM SYSTEMS

Users shall not:

  • reproduce educational content without authorization;

  • redistribute Platform materials;

  • upload educational materials to external systems;

  • record courses, workshops, mentorship sessions, or enterprise activities without authorization;

  • sublicense or resell educational access;

  • create competing educational products using Platform materials;

  • remove copyright notices or proprietary markings;

  • commercially exploit educational content improperly;

  • use Platform materials to train external AI systems;

  • replicate educational methodologies improperly;

  • replicate enterprise systems improperly.

Educational Content includes, without limitation:

  • courses;

  • frameworks;

  • methodologies;

  • simulations;

  • AI-enabled educational systems;

  • presentations;

  • templates;

  • assessments;

  • credential systems;

  • educational structures;

  • enterprise educational systems;

  • operational methodologies;

  • enterprise reporting structures;

  • Platform architectures.

Unauthorized use of educational content, credential systems, AI-enabled systems, operational systems, or enterprise systems may constitute intellectual property infringement, operational misuse, enterprise misconduct, or cybersecurity abuse.

 

7. ACCOUNT SECURITY, ACCESS GOVERNANCE, AND SUBSCRIPTION MISUSE

Users remain solely responsible for maintaining confidentiality and security of account credentials, enterprise access credentials, authentication systems, and access permissions.

Users shall not:

  • share credentials improperly;

  • permit unauthorized access;

  • pool subscriptions improperly;

  • manipulate seat allocations;

  • create fraudulent accounts;

  • impersonate individuals or organizations;

  • bypass enterprise licensing restrictions;

  • manipulate enterprise reporting systems;

  • manipulate credential systems;

  • circumvent operational access controls;

  • misuse administrative privileges.

Enterprise Clients remain responsible for governance of Authorized Users, enterprise access administration, organizational access management, credential administration, enterprise onboarding, and enterprise operational compliance.

AX Institute reserves sole discretion regarding enterprise governance methodologies, credential governance methodologies, operational access restrictions, enterprise enforcement methodologies, and account security controls.

 

8. UNAUTHORIZED COMMERCIAL ACTIVITIES

The Platform and Services are intended solely for authorized educational, organizational learning, executive education, certification, enterprise learning, and professional development purposes.

Users shall not:

  • conduct unauthorized advertising;

  • engage in unauthorized solicitation;

  • conduct spam activities;

  • create competing educational offerings using Platform materials;

  • use the Platform for unauthorized commercial exploitation;

  • resell subscriptions improperly;

  • resell certifications improperly;

  • resell enterprise educational access improperly;

  • misuse AX Institute branding;

  • create deceptive enterprise relationships;

  • imply unauthorized institutional affiliations.

AX Institute reserves sole discretion regarding whether conduct constitutes unauthorized commercial activity, enterprise misuse, educational misuse, operational abuse, or institutional misuse.

 

9. COMMUNITY CONDUCT, PROFESSIONAL PARTICIPATION, AND EDUCATIONAL INTEGRITY

Users participating in educational activities, enterprise environments, workshops, mentorship programs, forums, enterprise cohorts, AI-enabled systems, or community spaces shall maintain respectful, professional, lawful, and ethical conduct.

Users shall not engage in:

  • harassment;

  • intimidation;

  • discriminatory conduct;

  • abusive behavior;

  • malicious disruption;

  • hate speech;

  • defamatory conduct;

  • fraudulent reviews;

  • coordinated attacks;

  • enterprise disruption;

  • educational sabotage;

  • unauthorized solicitation;

  • credential fraud;

  • plagiarism;

  • cheating;

  • impersonation;

  • misuse of AI systems where prohibited;

  • academic misconduct.

Educational integrity obligations remain subject to the Academic Integrity Policy and Learner Conduct Policy.

Community conduct obligations remain subject to the Community and Professional Conduct Policy.

 

10. MONITORING, TELEMETRY, INVESTIGATIONS, AND OPERATIONAL GOVERNANCE

AX Institute reserves the right to:

  • monitor Platform usage;

  • review operational logs;

  • review analytics systems;

  • review AI-enabled systems;

  • review enterprise systems;

  • monitor credential systems;

  • preserve operational records;

  • investigate suspicious activity;

  • investigate enterprise misuse;

  • investigate cybersecurity threats;

  • implement automated monitoring systems;

  • implement AI-enabled monitoring systems;

  • implement fraud-detection systems;

  • cooperate with law enforcement authorities;

  • cooperate with enterprise administrators;

  • implement operational restrictions;

  • preserve operational continuity.

Monitoring may involve:

  • access logs;

  • telemetry systems;

  • authentication records;

  • enterprise analytics;

  • AI-enabled monitoring systems;

  • operational metadata;

  • credential activity;

  • content access patterns;

  • enterprise reporting systems;

  • fraud detection systems;

  • operational governance systems.

AX Institute reserves sole discretion regarding operational governance methodologies, monitoring methodologies, investigation procedures, operational evidence determinations, cybersecurity procedures, AI-enabled monitoring systems, and enforcement methodologies.

 

11. ENFORCEMENT ACTIONS

Where violations are suspected or confirmed, AX Institute may:

  • issue warnings;

  • suspend or terminate accounts;

  • revoke subscriptions;

  • revoke enterprise access;

  • revoke credentials or certifications;

  • disable APIs or integrations;

  • restrict enterprise systems;

  • remove educational content;

  • implement technological blocking measures;

  • suspend workshops or mentorship access;

  • pursue legal remedies;

  • seek injunctive relief;

  • recover damages and operational costs;

  • notify enterprise administrators;

  • coordinate with law enforcement authorities.

Serious violations may result in immediate enforcement without prior notice.

AX Institute reserves sole discretion regarding enforcement methodologies, operational restrictions, credential governance actions, enterprise governance actions, cybersecurity responses, or operational remedies.

 

12. ENTERPRISE, ORGANIZATIONAL, AND INSTITUTIONAL ACCESS

Enterprise Clients remain responsible for:

  • governance of Authorized Users;

  • prevention of unauthorized access;

  • enterprise credential management;

  • enterprise operational compliance;

  • enterprise governance procedures;

  • organizational compliance with licensing restrictions;

  • enterprise reporting governance.

AX Institute reserves the right to audit, review, investigate, suspend, restrict, or terminate enterprise access where enterprise misuse, cybersecurity concerns, operational abuse, credential misuse, unauthorized sharing, or policy violations are suspected.

AX Institute may coordinate investigations, operational reviews, enterprise governance reviews, credential reviews, or cybersecurity reviews with authorized enterprise representatives where reasonably necessary.

 

13. LIMITATION OF LIABILITY

To the maximum extent permitted by applicable law, AX Institute, AX, and Active Patterns Inc. shall not be liable for:

  • cybersecurity incidents;

  • operational interruptions;

  • AI-enabled system interruptions;

  • enterprise disruptions;

  • enterprise governance decisions;

  • credential restrictions;

  • operational restrictions;

  • educational interruptions;

  • third-party system failures;

  • monitoring activities;

  • enterprise enforcement actions;

  • automated security controls;

  • indirect damages;

  • consequential damages;

  • lost profits;

  • lost business opportunities;

  • lost educational opportunities;

  • operational disruptions;

  • reputational impacts.

Maximum aggregate liability relating to Platform usage, enterprise access, subscriptions, enterprise learning activities, credential systems, AI-enabled systems, operational systems, educational activities, or Services shall not exceed the amount paid for applicable Services during the preceding twelve (12) months.

Certain jurisdictions may not permit certain limitations. In such cases, liability shall be limited to the maximum extent permitted by applicable law.

 

14. GOVERNING LAW AND DISPUTE RESOLUTION

This Policy shall be governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles.

To the maximum extent permitted by applicable law, disputes relating to this Policy shall be resolved solely on an individual basis and not through class, collective, representative, coordinated, consolidated, or mass proceedings.

Users expressly waive any right to participate in class actions, coordinated proceedings, representative proceedings, collective proceedings, consolidated proceedings, or mass proceedings to the maximum extent permitted by applicable law.

 

15. NO WAIVER OF RIGHTS

Failure by AX Institute to enforce any provision of this Policy shall not constitute waiver of any rights, remedies, operational protections, enforcement rights, enterprise governance rights, credential governance rights, cybersecurity rights, or institutional protections.

 

16. CHANGES TO THIS POLICY

AX Institute reserves the right to modify, amend, replace, supplement, discontinue, or update this Policy at any time to reflect:

  • cybersecurity developments;

  • AI developments;

  • operational requirements;

  • enterprise governance developments;

  • legal developments;

  • technological developments;

  • educational developments;

  • credential governance developments;

  • Platform operational changes.

Updated versions become effective upon posting unless otherwise required by applicable law.

Continued use of the Platform following updates constitutes acceptance of revised terms.

 

17. ASSIGNMENT

This Policy may be assigned, transferred, delegated, subcontracted, novated, or otherwise transferred by AX Institute in connection with mergers, acquisitions, restructurings, financing arrangements, reorganizations, enterprise restructurings, transfers of operations, or transfers of business operations or assets.
