AX INSTITUTE ACCESSIBILITY POLICY AND ACCESSIBILITY STATEMENT

This Accessibility Policy and Accessibility Statement (“Policy”) describes AX Institute’s approach to accessibility, inclusion, digital accessibility, educational accessibility, accommodation practices, and equitable participation in connection with the educational services, digital platforms, subscriptions, enterprise learning services, certifications, workshops, mentorship programs, AI-enabled educational services, and related offerings provided through AX Institute.

AX Institute is operated by Active Patterns Inc. under the brands AX Institute and AX (“AX Institute”, “AX”, “Institute”, “we”, “our”, or “us”).

This Policy applies to:

· associated websites, applications, portals, educational platforms, learning management systems, subscription systems, enterprise learning environments, digital services, AI-enabled educational systems, and related infrastructure (collectively, the “Platform”);
· educational programs, certifications, subscriptions, workshops, enterprise learning services, mentorship programs, digital content, and related Services.

1. ACCESSIBILITY COMMITMENT

AX Institute is committed to supporting accessibility, inclusion, equitable participation, and inclusive educational experiences for learners, subscribers, enterprise participants, instructors, mentors, organizations, and users interacting with the Platform or Services.

AX Institute seeks to make commercially reasonable and operationally appropriate efforts to improve accessibility across:

· digital educational content;
· online learning systems;
· websites and applications;
· educational technologies;
· enterprise learning systems;
· workshops and events;
· mentorship services;
· AI-enabled educational systems;
· communications and support services;
· workforce capability development;
· leadership development participation;
· executive learning participation;
· applied professional development;
· inclusive organizational learning opportunities;
· equitable access to capability-building experiences.

AX Institute recognizes that accessibility is an ongoing process involving continuous evaluation, operational improvement, technological evolution, institutional development, and evolving accessibility expectations.

AX Institute recognizes that accessibility may involve varying physical, sensory, cognitive, linguistic, technological, educational, geographic, operational, and enterprise considerations depending on individual learner needs, technologies, enterprise environments, educational contexts, and evolving digital learning environments.

AX Institute seeks to support educational environments that encourage inclusive participation, professional development, executive learning, organizational capability development, and respectful educational access across differing learner needs and enterprise environments.

 

2. ACCESSIBILITY STANDARDS

AX Institute seeks to make commercially reasonable efforts to align applicable digital experiences with generally recognized accessibility standards, which may include:

· the Accessibility for Ontarians with Disabilities Act (“AODA”);
· the Web Content Accessibility Guidelines (“WCAG”);
· evolving accessibility best practices;
· applicable accessibility laws where reasonably required.

AX Institute seeks to support accessibility through commercially reasonable, operationally appropriate, technologically evolving, and continuously improving accessibility practices appropriate to the nature of the Services, educational delivery models, enterprise learning environments, credential requirements, AI-enabled systems, and technological infrastructure.

AX Institute does not warrant or guarantee that all content, systems, technologies, integrations, third-party tools, educational materials, or Platform components will always fully satisfy all accessibility standards, technical specifications, assistive technology requirements, or regulatory interpretations in every jurisdiction or circumstance.

Accessibility implementation may vary depending on:

· technology limitations;
· third-party systems;
· operational feasibility;
· educational delivery models;
· enterprise configurations;
· evolving standards;
· AI-enabled systems;
· device compatibility;
· browser compatibility;
· resource availability;
· assistive technology compatibility;
· operational or security requirements.

 

3. DIGITAL ACCESSIBILITY MEASURES

AX Institute may implement accessibility measures including, where operationally and technologically feasible:

· keyboard navigation support;
· text readability improvements;
· accessible navigation structures;
· captioning or transcripts where reasonably available;
· scalable text compatibility;
· compatibility with assistive technologies;
· accessibility-conscious content design;
· accessibility review practices;
· responsive design considerations;
· accessibility-oriented educational delivery improvements.

Accessibility-supporting technologies may evolve over time and may include AI-enabled accessibility tools, adaptive learning technologies, automated captioning technologies, translation systems, personalization systems, accessibility-enhancement technologies, or assistive educational technologies where operationally appropriate.

Accessibility efforts may evolve over time as technologies, standards, educational practices, enterprise learning environments, operational requirements, AI-enabled systems, and accessibility tools continue to develop.

AX Institute reserves the right to modify, replace, redesign, evolve, suspend, or discontinue accessibility-related features, technologies, integrations, or educational delivery approaches where operationally necessary.

 

4. EDUCATIONAL CONTENT AND LEARNING ACCESSIBILITY

AX Institute recognizes that educational accessibility may involve differing learner needs, technologies, devices, learning environments, accommodation considerations, enterprise requirements, accessibility technologies, and educational delivery models.

Where reasonably feasible and operationally appropriate, AX Institute may consider accessibility-related accommodations involving:

· alternative educational formats;
· captioning availability;
· transcript availability;
· accessible communication methods;
· workshop accessibility considerations;
· mentorship accessibility considerations;
· enterprise learning accommodations;
· educational delivery adjustments;
· accessibility-oriented educational support approaches.

Accommodation availability may depend on:

· operational feasibility;
· technological limitations;
· educational integrity requirements;
· third-party provider capabilities;
· enterprise arrangements;
· timing considerations;
· resource availability;
· accreditation or certification requirements;

AX Institute reserves the right to determine reasonable accommodation approaches in light of operational, educational, technological, institutional, accreditation, enterprise, cybersecurity, credentialing, and security considerations.

Accessibility accommodations, educational adjustments, or alternative participation approaches shall not require AX Institute to compromise educational integrity, credential standards, assessment integrity, accreditation requirements, enterprise governance requirements, cybersecurity protections, operational security requirements, or institutional standards.

 

5. AI-ENABLED SYSTEMS AND ACCESSIBILITY

AX Institute may use AI-enabled educational systems, recommendation systems, adaptive learning systems, personalization technologies, analytics systems, educational automation technologies, translation systems, accessibility-enhancement technologies, or AI-supported educational tools in connection with the Services.

AX Institute may seek to improve accessibility, usability, personalization, learner engagement, educational participation, executive learning accessibility, organizational learning accessibility, or educational delivery through evolving technologies and AI-enabled systems where operationally appropriate.

AI-enabled accessibility technologies may support educational participation, translation, accessibility adaptation, educational personalization, content summarization, communication support, learner assistance, accessibility-oriented navigation, or educational support activities, but may also involve technological limitations, inaccuracies, operational constraints, evolving capabilities, third-party dependencies, or inconsistent outputs.

AX Institute does not warrant that AI-enabled educational systems, adaptive technologies, automated systems, personalization systems, accessibility-enhancement systems, or third-party AI technologies will operate error-free, uninterrupted, universally compatible, or fully accessible in all circumstances.

Certain AI-enabled technologies may involve evolving accessibility capabilities, technological limitations, third-party integrations, operational constraints, or changing provider capabilities.

 

6. THIRD-PARTY PLATFORMS, SYSTEMS, AND TECHNOLOGIES

The Platform and Services may incorporate or integrate third-party systems, technologies, software, plugins, educational platforms, webinar systems, AI-enabled tools, analytics providers, payment processors, enterprise systems, communication tools, embedded services, accessibility technologies, or assistive technologies.

AX Institute does not control all third-party technologies, integrations, providers, systems, or third-party accessibility practices.

Accordingly:

· third-party systems may not always fully conform to accessibility standards;
· accessibility functionality may vary between providers or technologies;
· accessibility experiences may differ depending on device, browser, software, integration, enterprise configuration, or platform configuration;
· accessibility capabilities may evolve independently of AX Institute systems;
· third-party operational changes may affect accessibility functionality.

AX Institute makes no guarantee regarding the accessibility compliance, uninterrupted accessibility, accessibility functionality, operational continuity, compatibility, or evolving accessibility practices of third-party systems or services.

Where reasonably operationally feasible, AX Institute may seek to work with technology providers, enterprise providers, educational technology vendors, accessibility technology vendors, or integrated service providers to support evolving accessibility practices over time.

Users should review applicable third-party accessibility information where available.

 

7. ACCESSIBILITY FEEDBACK AND ACCOMMODATION REQUESTS

AX Institute welcomes accessibility feedback, accessibility-related suggestions, and reasonable accommodation requests.

Users experiencing accessibility barriers or requiring accessibility-related assistance may contact AX Institute using the contact information provided below.

Accessibility requests may include:

· accessibility feedback;

AX Institute will make commercially reasonable efforts to review accessibility-related inquiries within a reasonable timeframe.

Accessibility-related accommodations, educational adjustments, enterprise coordination efforts, or operational accessibility measures may involve collaborative discussions between AX Institute, learners, enterprise representatives, instructors, facilitators, mentors, accessibility coordinators, or authorized organizational contacts where reasonably appropriate.

 

8. CONTINUOUS IMPROVEMENT

AX Institute recognizes that accessibility standards, technologies, educational practices, AI-enabled systems, enterprise learning environments, digital accessibility expectations, assistive technologies, and enterprise accessibility requirements continue to evolve.

Accordingly, AX Institute reserves the right to:

· improve accessibility practices;
· modify accessibility features;
· introduce new accessibility technologies;
· revise accessibility approaches;
· update accessibility procedures;
· transition technologies;
· redesign educational delivery methods;
· modify accessibility-related operational practices;
· evolve AI-enabled accessibility approaches;
· implement updated accessibility-oriented educational technologies.

Accessibility improvements may occur incrementally and may vary across Services, educational content, technologies, enterprise systems, AI-enabled systems, third-party systems, or Platform components.

AX Institute recognizes that accessibility practices, AI-enabled accessibility technologies, educational delivery models, assistive technologies, enterprise accessibility expectations, and digital accessibility standards may continue evolving over time.

 

9. LIMITATION OF ACCESSIBILITY GUARANTEES

AX Institute seeks to support accessibility, inclusive participation, and accessible educational experiences through commercially reasonable efforts.

However, AX Institute does not guarantee:

· uninterrupted accessibility;
· universal compatibility;
· complete accessibility compliance in all jurisdictions;
· compatibility with all assistive technologies;
· uninterrupted operation of accessibility features;
· accessibility of third-party technologies;
· error-free operation of digital accessibility tools;
· accessibility functionality under all technical conditions;
· universal accessibility across all technologies, integrations, or enterprise environments.

Temporary interruptions, maintenance activities, technological limitations, browser limitations, software limitations, AI-enabled system limitations, third-party failures, cybersecurity incidents, enterprise configurations, operational changes, or evolving technological environments may affect accessibility functionality.

Nothing in this Policy creates fiduciary, advisory, employment, agency, partnership, professional-client, or legally guaranteed accessibility relationships between users and AX Institute.

 

10. ENTERPRISE, ORGANIZATIONAL, AND EDUCATIONAL PARTNERSHIPS

Where Services are provided through enterprise, institutional, governmental, organizational, educational, or employer-sponsored arrangements, additional accessibility practices, accommodations, enterprise procedures, operational requirements, educational procedures, or contractual accessibility obligations may apply.

AX Institute reserves the right to coordinate accessibility-related matters with authorized organizational representatives, enterprise administrators, educational institutions, enterprise accessibility contacts, or designated enterprise representatives where reasonably necessary for operational, educational, accessibility, accreditation, enterprise administration, or organizational coordination purposes.

Enterprise Clients remain responsible for communicating organizational accessibility requirements, enterprise accommodation considerations, regulated accessibility obligations, or enterprise governance requirements reasonably necessary for enterprise learning coordination.

 

11. LIMITATION OF LIABILITY

To the maximum extent permitted by applicable law, AX Institute, AX, and Active Patterns Inc. shall not be liable for:

· accessibility interruptions;
· assistive technology incompatibilities;
· third-party accessibility limitations;
· AI-enabled accessibility limitations;
· enterprise technology limitations;
· browser or device compatibility limitations;
· operational interruptions;
· accessibility feature limitations;
· technological failures;
· educational interruptions;
· indirect damages;
· consequential damages;
· lost educational opportunities;
· lost business opportunities;
· operational disruptions.

Maximum aggregate liability relating to accessibility-related Services, educational participation, enterprise participation, subscriptions, certifications, workshops, mentorship programs, AI-enabled educational systems, or Platform usage shall not exceed the amount paid for applicable Services during the preceding twelve (12) months.

Certain jurisdictions may not permit certain limitations. In such cases, liability shall be limited to the maximum extent permitted by applicable law.

 

12. GOVERNING LAW

This Policy shall be governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles.

To the maximum extent permitted by applicable law, disputes relating to this Policy shall be resolved solely on an individual basis and not through class, collective, representative, coordinated, consolidated, or mass proceedings.

Users expressly waive any right to participate in class actions, collective proceedings, representative proceedings, coordinated proceedings, consolidated proceedings, or mass proceedings to the maximum extent permitted by applicable law.

 

13. CHANGES TO THIS POLICY

AX Institute reserves the right to modify, amend, replace, supplement, discontinue, or update this Policy at any time to reflect:

· legal developments;
· accessibility developments;
· technological changes;
· AI-enabled technology developments;
· educational developments;
· enterprise operational requirements;
· cybersecurity developments;
· evolving accessibility standards;
· evolving enterprise accessibility expectations;
· evolving educational delivery practices.

Updated versions become effective upon posting unless otherwise required by applicable law.

Continued use of the Platform or Services following updates constitutes acceptance of the revised Policy.

 

14. ASSIGNMENT

This Policy may be assigned, transferred, delegated, subcontracted, novated, or otherwise transferred by AX Institute in connection with mergers, acquisitions, restructurings, financing arrangements, reorganizations, enterprise restructurings, transfers of operations, or transfers of business operations or assets.
